Fine Art
TERMS & CONDITIONS
COPYRIGHT

All artwork created by the artist remains the intellectual property of the artist. The artist retains full copyright and ownership of the artwork at all times, even after the physical artwork has been sold.
The client purchases the original artwork only and does not acquire any reproduction or commercial rights. The artwork may not be reproduced, copied, distributed, published, or used for commercial purposes without the artist’s written permission.
The artist reserves the right to display commissioned artwork on her website, social media platforms, and in promotional materials.

UNAUTHORIZED REPRODUCTION AND AI PROTECTION
The artwork may not be copied, reproduced, scanned, digitized, uploaded, or otherwise used for the purpose of creating prints, merchandise, or digital reproductions without the artist’s explicit written permission.
This includes, but is not limited to, the use of the artwork for print-on-demand platforms (such as Etsy, Redbubble, Society6, or similar services), merchandise production, NFTs, digital assets, or any other commercial or resale purposes.
The artwork may also not be used for training, developing, or operating artificial intelligence (AI), machine learning systems, image generators, or any automated data collection or image-generation technologies.
Any unauthorized reproduction, digital use, AI training, or commercial exploitation of the artwork is strictly prohibited.

REFERENCE PHOTOS
The client must provide reference photos that were either taken by them or used with permission from the photographer.
If the commission is intended as a gift, it is the client’s responsibility to obtain suitable reference photos of the recipient’s pet.
By sending reference photos, the client grants the artist permission to use these images for promotional purposes, including showing comparisons between the reference photo and the finished artwork.
If requested, the client may ask for the reference images not to be displayed publicly.

QUOTES
Each commission is unique and prices are determined individually based on size, complexity, and materials.
Once the artist has a clear understanding of the client’s request, a quote will be provided. Quotes remain valid for 30 days.
If changes are made to the brief or commission details after the quote has been issued, the quote may need to be revised. The client will always be informed if any changes affect the final price.

PAYMENT
To secure a commission slot, a non-refundable deposit of 30% is required.
This deposit confirms the booking and allows the artist to schedule the work.
Once the artwork is completed and approved by the client, the remaining balance must be paid before the artwork is shipped. Any applicable shipping costs will be included in the final invoice.

CANCELLATIONS
The client may wait to make the final payment until they are satisfied with the completed artwork.
If the client decides to cancel the commission before the final payment is made, the remaining balance will not be required. However, the deposit and any payments already made will not be refunded, as they compensate for the time and work already invested in the project.
If the final payment has not been received within 15 days after completion, and no communication has been received from the client, the commission will be considered cancelled.

SHIPPING
All artwork is carefully packaged to ensure safe delivery and is shipped with a tracking number.
If the artwork is intended as a gift, it can be shipped directly to the recipient. The client simply needs to provide the delivery address.
In the rare event that the artwork is damaged during shipping, the client should photograph the damage and contact the artist as soon as possible.
Depending on the situation, the artwork may need to be returned. If necessary, the artist will create a replacement portrait at no additional cost. Please note that this may require additional time depending on the current waiting list.

GIFT VOUCHERS
Gift vouchers can be used as full or partial payment for a commission.
Vouchers must be used before their expiration date, which is typically 12 months from the date of purchase.
Gift vouchers are non-refundable and cannot be exchanged for cash.

ARTISTIC FREEDOM
All artwork is created in the artist’s personal style and is intended to be a unique, handcrafted piece of art.
While the artist works closely with the provided reference photos, the client should not expect an exact photographic copy. The artist retains creative freedom in interpreting the subject.
This may include adjustments such as refining the composition, simplifying or altering the background, slightly cropping the subject, or making minor artistic enhancements to achieve the best final result.

RIGHT TO REFUSE A COMMISSION
The artist reserves the right to refuse a commission request at her discretion.

By placing a commission order, the client confirms that they have read and agreed to these Terms & Conditions.
